Are you talking about investigating unfaithful spouses?
Not necessarily. Indiana is a no-fault divorce state. You do not have to establish infidelity to file for divorce. However, often times there are other issues that bear investigating when a spouse is suspected of being unfaithful. For example, many couples have substantial joint assets and a wronged spouse needs to protect his or her share of those assets. Do you take on private clients?
Not usually. When contacted by an individual who suspects a spouse of cheating, we always recommend consulting with an attorney to explore legal options before hiring an investigator. If a client just wants to know for sure if their spouse is unfaithful, we will determine on a case by case basis if we can assist.
What about child custody cases?
Most of our family law investigations involve petitions for modification of child custody, well after the marriage dissolution. Many divorce agreements place restrictions on one party or the other regarding shared custody of young children; for example, a new “boyfriend” or “girlfriend” is prohibited from staying overnight if the children are there. An investigation is necessary to prove co-habitation, in addition to determining details about this new person in the children’s lives.
Are you available to testify?
Yes, when necessary. We provide our clients with a detailed investigation report, supported by photographic or video evidence. Our investigators are experienced in courtroom decorum.
How much do you charge?
Our family law cases are billed by the hour plus expenses. We work closely with our attorney clients in establishing budgets for an investigation, and work within those parameters. For all family law investigations, we require a retainer arrangement.
